On June 20-21, 2023, a peaceful protest staged by villagers in Soyudlu village of Gadabay, Azerbaijan, against the construction of a second water reservoir for waste by a gold mine company was forcefully dispersed by the police. The demonstrators were concerned about the potential ecological damage caused by the company's activities and the establishment of the new reservoir.
Despite legal provisions outlining restrictions on the use of force during protests, the police resorted to violence and unnecessary pepper spray, raising concerns about the proportionality of their actions. Specifically, according to Article 7 of the Law of the Republic of Azerbaijan "On Freedom of Assembly", limitations on the freedom of assembly must be absolutely necessary to achieve the goal that led to the restriction. Similarly, Article 26 of the Law on Police, states that the use of physical force, special means or firearms in absolutely necessary cases, used in accordance with the requirements of the law, must be proportionate to the level of danger.
On the first day of the protest, there was a conflict between the police and participating residents: 5 individuals were arrested under Article 513.2 of the Code of Administrative Offenses (violation of the order of organising and holding meetings), and 1 protester was fined 1,500 manats (800 EUR).
On June 24, public activist Giyas Ibrahim condemning police’s actions towards villagers on social media was arrested for 30 days. Several journalists covering the events were also detained. The government created a Commission to investigate the issue. The Minister of Ecology visited the area, while the head of local executive power met with residents. The police announced launching an investigation into police officers, accused of using excessive force against the villagers. However, the result of the investigation is not yet known to the public. The police also imposed prohibitions on entry and exit to the village for more than 10 days, adding to the tense atmosphere.
